"Womanizer" Chart Updates

"Womanizer" is definitely still a contender in today's music industry weeks after its debut.

The song has slipped one spot on Billboard's Hot 100 chart to #5, just behind Pink's "So What" coming in at #4.

"Womanizer" also remains in the top 5 on iTunes' Top Songs chart, coming in at #3 just behind Taylor Swift's "You're Not Sorry" at #2 followed by Beyonce's "If I Were A Boy" at #1.

Fortunately "Womanizer" has moved up 3 spots on Mediabase, which measures radio spins, placing at #11.

In fact, "Womanizer" has already placed higher on Mediabase then some of Britney's other biggest hits including "Gimme More" (#16), "Stronger" (#14), and "I'm A Slave 4 U" (#18).

Keep requesting, downloading and supporting Britney with her first single off Circus! Spread the word!

Britney Agrees to Permanent Conservatorship

Britney Spears may be comebacking like a madwoman, but the court thinks she can still use some guidance on that road to redemption.

The popster's conservatorship arrangement with father Jamie Spears was made permanent today, with no objection coming from the 26-year-old "Womanizer" warbler. If the terms of the deal remain the same, her dad will continue to oversee her estate, finances, legal affairs and medical care along with attorney Andrew Wallet.

"The court finds the proposed permanent conservatorship is necessary and appropriate," said Los Angeles Superior Court Commissioner Reva Goetz, who has been presiding over the Spears saga for the past year, at a Tuesday status hearing.

And while Britney was no fan of the arrangement back when it was imposed Feb. 1, her attorney informed the court today that his client had requested he not argue with Goetz's ruling.

Besides, it's not as if permanent means forever.

"The permanent conservatorship doesn't have a set date to expire," court public information spokeswoman Vania Stuelp tells E! News.

"In order to make it go away, someone has to petition the court. It was supposed to expire on Dec. 31. It's not anymore."

In the meantime, an evaluation detailing Spears' psychological fortitude has been completed and will remain sealed, Goetz said. Another status hearing has been set for Dec. 22.

But while this may all be as-expected news for Britney's camp, it doesn't bode well for the lawsuit against her filed by former manager Johnny Wright.

Saying that Spears' "capacity issue remains open and has not been resolved one way or another," Goetz ruled earlier today that Wright's attorneys are not allowed to depose Spears, whom he says owes thousands in unpaid commissions, until the conservatorship ends.

"We think it's reasonable," Wright's lawyer, Clay Townsend, who had been hoping to have Brit sit for a deposition Nov. 17, tells E! News. "Being on the cover of OK magazine, signing a big contract with AEG to go on a world tour, going on Good Morning America—gosh, it seems fairly reasonable to try to do a deposition in late November. It's not like she is in the hospital and we are dying to go down and take her deposition."

Instead, they will have to speak with ruler-of-the-roost Jamie Spears next month.

"She seemed to be doing so well, that we thought it was not unreasonable," Townsend added. "My client Johnny Wright still has great affection for Britney. He worked with Britney for a long time in the early days. So that last thing that we would want to do was to harass her."

Goetz said that she will revisit the deposition issue Feb. 2.

Britney Spears to perform live on Good Morning America

Britney Spears will perform live in Bryant Park on ABC's Good Morning America on December 2, to promote her sixth studio album Circus, which drops that day. "Everybody wanted her - she was the big get - but 'GMA' and ABC outfoxed the 'Today' and NBC," sources tell Pagesix. Britney has yet to decide if she'll do an interview. The performance on December 2, which is also Britney's 27th birthday, would be her first live performance, not involving lip synching, since the break down of her marriage in 2006. Britney's last live performance at MTV VMAs in 2007 was a disaster as she appeared to sleepwalk on stage failing to even lip synch correctly. Britney Spears is scheduled to perform Womanizer, the first to be released single from Circus, in UK in December on X-Factor. A 90- minute film produced by MTV and tentatively titled For the Record, documenting Britney Spears return to show biz with the upcoming release of her sixth studio album Circus will air on November 30 at 10 p.m. on MTV. Mistrial Declared in Britney Case

The judge in the Britney Spears misdemeanor trial for driving without a California license, has just declared a mistrial after the deadlocked jury said they were unable to reach a unanimous verdict following nearly three days of deliberation.

"It's clear to me you worked very hard and I appreciate your time and effort," the judge told the jurors after they affirmed they were hopelessly deadlocked on a verdict.

It was revealed following the court's announcement that the jury's consistent 10-2 votes on all five ballots had been leaning toward acquitting the pop star of the charges, with only two holdouts feeling she should be found guilty.

Jury foreman, Gary Moy, 45, told reporters after today's announcement that he was one of the two that had consistently voted to convict Britney and said he felt the remaining 10 jurors were biased toward acquitting her because of her superstar status.

"The prosecution did a fine job presenting the evidence," said Moy.

The prosecutor will announce later today whether or not they intend on a retrial, but Brit's attorney is betting they'll leave while they're ahead.

"Can you imagine re-prosecuting a misdemeanor?" he asked after today's verdict. "They don't even re-prosecute murder trials."

Flanagan also said he felt that the prosecution was vindictive of Britney, given her superstar status.

"They offered her a chance to buy her way out of the case," he said about an earlier rejected plea deal. "But she wanted to be treated like an ordinary person and have her case heard by a jury."
At 10:35 am on Tuesday, the jury told the judge that they were still deadlocked, and he then gave each attorney five minutes to once again run down their side of the story for the panel of eight women and four men in the Van Nuys, Calif., courthouse.

The prosecutor in the case, Michael Amerian, reminded the jury that, as late as a week before the parking lot incident, Britney had actually signed a legal document claiming she was a resident of California. He also claimed that, even if the jury allows that Brit is indeed a Louisiana resident, there is no proof she had a valid Louisiana license at the time.

Countering these claims, Brit's attorney, J. Michael Flanagan, repeated his assertion that Britney had been intending to move back home to Louisiana in August 2007, when she accidentally hit another vehicle in an L.A. parking lot, and that she only stayed in California to fight the custody battle with ex-husband Kevin Federline.

He also pointed out that the pop star's father, Jamie Spears, testified under oath that his daughter did indeed have a Louisiana license at the time of the accident.

"I want to escape this case," Flanagan told OK! after giving his second closing argument. "I've tried about 500 cases and I've never seen something like this, I've seen hung juries before but never have I had to give additional closing arguments for a case like this... They should have declared this a mistrial a day ago. I looked at the jury and they did not look happy. I did not see a lot of happy faces."

"Womanizer" Back At #1 On iTunes!

While you were getting drunk celebrating last night that Britney has once again claimed the top spot on iTunes. Britney is once again in first place on iTunes' Top Songs chart, knocking Taylor Swift's (who?) "Fearless" to number two, followed by T.I.'s "Life Your Life" at number three."Womanizer" was knocked out of the top 5 after iTunes unexpectedly removed the song from their database, claiming the song was "temporarily removed by the content provider." A.K.A. they screwed up.Well, the song is back - and right where it should be at number 1.
Christina Aguilera's "Keeps Getting Better" is nowhere near the top 15.
And people thought Xtina was back? WRONG!!!

Congrats Britney!

Sooo I'm hearing iTunes is officially shutting down?

Christina On Britney:

"I'm rooting for Britney. It's great she is back on track."

Do I smell Jealousy?

Verdict for driving without a valid license trial is expected to be reached today!

A verdict for Britney's driving without a valid license trial is expected to be reached today. Britney, who was involved in a minor fender-bender last August, has not been required to make an appearance at the hearings as it is a misdemeanor case. Britney's legal representation, Michael Flanagan, has attended to all of Britney's legal matters along with her father / co-conservator Jamie Spears, who tirelessly manages all of Britney's legal woes.According to People.com, Flanagan previously chose to opt out of a plea deal in which Britney would owe a $150 dollar fine and 1 year probation. "My client will never plead guilty to this charge, which should be reduced to an infraction," said Flanagan, who twice turned down prosecutors' plea deals. "We'll appeal any conviction." As a result, Britney, if found guilty, could face up to 6 months in jail and a owe a $1000 dollar fine. A 12 person jury, made of up of 10 women and 4 men including two alternates, had a "neutral" perception of Britney - though most expressed some sort of compassion for the popstar. "I think she's a train wreck, but it's not her doing," said Juror No. 1. "She has some not good people around her. It's a sad situation." Other members in the jury agreed, adding that Britney faces severe medical problems, "but with the right help, she'll be okay." Another claiming the trial was "ridiculous."People.com reports Spears' attorney Michael Flanagan argued that Britney, who currently possesses a valid Louisiana state license, was not required to get a California state license until she becomes a permanent resident of the state: "She regards Louisiana as her [permanent residence]," Flanagan said in his opening statement last Thursday. "She's building a new house there, where she hopes to return as soon as her custody situation is straightened out."Flanagan also argued that Britney "currently pays income taxes in Louisiana, is registered to vote there and never applied for a homeowner's exemption for a tax break on her Los Angeles home."Jamie Spears, who was called upon to testify by Flanagan, agrees, adding that Britney's prime reason for residing in Los Angeles is for the soul purpose of raising her two sons Sean Preston, & Jayden James."We're here with her kids," Mr. Spears said. "We have visitation rights. We have to stay to augment those rights." Britney will move back to Louisiana once "we can travel with the kids (out of state) and spend time there," her father said."Her home is Louisiana," Jamie continued. As for when she'll be returning to Louisiana, "There's plans right now," he said. When asked if he would allow Britney to testify, Mr. Spears said "no."Los Angeles Deputy City Attorney Michael Amerian, according to People, "countered Mr. Spears claims that Britney is a Louisiana resident by stating that Britney's voter status in Louisiana is 'inactive' because 'she hasn't voted there for some time.'"Amerian, who was interviewed outside the courthouse last Friday by x17online.com after no verdict was reached as expected, said Britney's hearing is unusual, but demanded misdemeanor charges be pursued. "I would say a very small percentage go to trial," Amerian said."Cases like this, where somebody is charged with driving without a valid license, are frequently pursued as misdemeanors, when, as here, a traffic collision occurred," revealed Amerian. "In this case there was a hit and run that occurred. While she was able to settle the hit and run with the victim, the driver's license charge still remained. It's when we have cases arising out of a collision, that we do pursue misdemeanor charges."Amerian also countered Flanagan's defense, claiming that Britney had signed, under penalty of perjury, a document stating she was a California resident when filing for divorce in Los Angeles back in 2006.Flanagan argued that Britney is "just here [in L.A.] trying to get her kids back.""She's been hospitalized, she's been driven crazy, do you blame her for wanting to go home?"Stay tuned today for a final verdict on this trivial, yet persistent case in the on-going saga of legal troubles for Miss Britney Spears.

GOOD LUCK,

BRITEY!!!

EXCLUSIVE "Womanizer" Music Video Details!

Britney has come a long way from her bizarre late-night debacles and promiscuous relationships to a current state of grace that has fans and followers rooting for her once again. "Womanizer," Britney's first single off her upcoming album "Circus," was released to radio late last week, with a digital release scheduled for October 7th. The music video, shot by director Joseph Kahn ("Stronger," "Toxic"), is scheduled for release next Friday, October 10th on ABC's 20/20 according to ABCnews.com. And now BreatheHeavy.com can reveal exclusive details of THE music video you have been anxiously waiting for these last few years. And I promise: no stripper poles, no white fur jackets, and definitely no cartoons. Britney's back, bitch, and she wants you to know - whether you're ready for it or not.Warning! Spoilers below! Ah, who are you kidding... you can't resist. The "Womanizer" music video takes place at the Elevate Lounge in the Takami Sushi & Robata Restaurant located in downtown Los Angeles. One scene shows Britney as a sexed-up waitres, wearing black boots, tight-black leather pants with an oversized black belt, a black leather vest with a white button-up cutoff vest underneath, and drenched in silver jewelry around her neck and wrists. Britney's left arm is tatted with red roses. The word "Womanizer" is written inside a broken heart on her upper arm and written again in black cursive a bit lower. Surrounded by dancers in similar outfits, Britney walks through the restaurant carrying a silver platter with a glass of brandy on top. To complete her Gothic-waitress look, Britney rocks a shoulder-length, dark auburn-colored wig and black nail polish.Another scene shows a playful and flirty Britney playing the role of a sexy secretary (a-la "How I Met Your Mother"), dressed in a black & white striped top, a knee-length leather skirt, black-rimmed spectacles and a short, black bob wig. Britney, wearing bright-red lipstick for the scene, plays with the love-interest in the video (wearing a black business suit and tie) - even photocopying his face in the office as she smiles to the camera.
But it's the sex-kitten Britney in a revealing, grey satin robe, peeping black bra, and pink belly-button ring, along with her signature tousled long blond hair shows fans just why they fell in love with the pop-star nearly 10 years ago. Here, Britney is cooking breakfast for her pursuer after a night of passion (yes, she gives him a lap-dance in bed), and brings the meal to her newly-found lover who happens to be wearing only white boxer-briefs at the table while the word "womanizer" flashes in the background. But what does Britney do after being scantily-clad and provocative towards the young man? Blows him a kiss, remembering that innocent, yet not-so-innocent, demure she displayed in her early days in pigtails and a school-girl uniform.Britney is later seen wearing the man's black business-jacket and tie, along with a black hat and sunglasses inside a car. Perhaps a quick escape after using the man she adamantly labels a womanizer for a little fun of her own?Britney proves herself in this video as a relevant music icon. It's sexy, it's wild, it's empowering, but more importantly it's that legendary pop video we've been waiting for since "Toxic."You say she's crazy? She's got your crazy, and I'm loving it.

Britney Interview On Z100!

Check out a transcript of the interview below:
JJ: It's so amazing to have you here, because all weekend on Z100 we were playing your new song, as well as classic Britney.
Britney: Thank you! That's so crazy, thank you for playing my songs like that, that's awesome.
JJ: You look amazing in person. The hair - everything. She's got the cool sunglasses on in the studio, she looks radiant.
Britney: Why, thank you. Oh, you're so nice. You're too kind, thank you.
JJ: So your sixth studio album, it took a while?
Britney: Yeah. Actually, I did it, I cut Circus two weeks ago. I've been working on this album for like six months now.
JJ: So, tell me about "Womanizer" real quick.
Britney: It's a really cool song. I like the fact that it's so empowering for girls because it's basically saying, you know, we know what you're up to. It's about guys cheating on other girls and stuff like that. It's kind of like a girl anthem. That's why I like it.
JJ: Did you expect that so many women would be able to relate to it?
Britney: That's exactly what I felt when I heard the song, you know what I mean? So hopefully the fans will see it that way, too.
JJ: And congratulations on the VMAs! Finally, huh?
Britney: I know, right!
JJ: And I heard that you weren't too crazy about the "Piece of Me" video?
Britney: I mean, it's a cool video, but I think by far I've done videos that are way better so I was really shocked that it got the award, you know?
JJ: So were you glad, or like, 'That's cool, but I didn't some other cool stuff!'
Britney (laughs): Yeah, but it was just inspiring though, 'cause now, you know, going forward with the videos that I'm doing now I can really go there and do something crazy and see what happens.
JJ: So I have to ask, are we going to see a tour?
Britney: Oh definitely next year, definitely.
JJ: So is that what's been up with all the dancing on the side?
Britney: Oh, yeah definitely.
JJ: Cool! So will it be a world tour? Or just the US?
Britney: Umm.. Probably all around the world.
JJ: Excellent! Anything else you want to say to your fans here in New York City?
Britney: I miss it here so much! I love it so much. It makes me... it's kind of like, bittersweet coming here 'cause I used to live here for two years! And when I come here, it's like, 'Man, I wish I had my apartment here still and stuff like that.' But I love it-it's the energy-it's crazy.
JJ: What's the one thing you miss about it here?
Britney (laughs): Um, the pizza!
JJ: So do you have one slice, or like, a whole pizza and then the treadmill?
Britney: Oh I eat! I eat what I want, I have to yes-definitely.
JJ: Advice for all the ladies-when you go on vacation, eat what you want and then go on the treadmill!
Britney: Yes, definitely.
JJ: Excellent, well I think we should hear "Womanizer" right now on the radio, would you like to introduce it?
Britney: Yes, this is my new song, "Womanizer." I hope you guys like it!

Britney Breaks Her Own Record! Again...

"Womanizer" just broke "Gimme More's record, of being the one song that has entered, the top 100 media base airplay charts most rapidly than any other song. Last year "Gimme More" debuted at #78 within the first 24 hours of its release, "Womanizer" debuted even better at #60 in the same period of time, with more than 5 million new listeners and 380 spins. As of now the song has had more than 6 million listeners and more than 500 spins. Congrats Britney!

Britney - who is set to release new album 'Circus' in November - will face competition from troubled star Amy Winehouse for the Act of 2008 award, despite several heavily criticized live performances from the 'Back To Black' singer this year. The 26-year-old singer will battle against Alicia Keys, Coldplay, Duffy and Leona Lewis in the Album of the Year category.
